YieldJump Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the yieldjump.com website (the “Website”), the YieldJump Platform, and the YieldJump mobile applications and Services (collectively, the “Services”). You agree that by visiting the Services or by registering or using the Services, you are entering a legally binding agreement with YieldJump Co-Owned Vacation Homes (“YieldJump”) based on these Terms and the Privacy Policy, which is hereby incorporated by reference (collectively referred to as the “Agreement”). Your access to and use of the Services are conditioned on your acceptance of and compliance with the Agreement.

1. Basic Terms

YieldJump provides a marketplace and management platform that connects real estate buyers with the opportunity to purchase an equity interest in a vacation home through a qualified LLC.

  • Ownership Structure: The terms of any real estate purchases initiated through the Services are provided in the specific real estate purchase agreement and the LLC Operating Agreement. YieldJump enables individuals to co-own vacation homes together in a multi-member limited liability company (“LLC”) designed for both personal use and rental yield.

  • Management & Yield: YieldJump provides property management and professional rental services managed via the Platform. By using these Services, you acknowledge that the property may be rented to third-party guests during periods of non-owner use to generate rental income for the LLC.

  • Eligibility: You must be at least 18 years of age and capable of forming a binding contract to use the Services.

  • Evolution of Services: The Services are always evolving. YieldJump reserves the right to modify, stop, or limit features of the Services (including rental management tools and portfolio access) at any time without prior notice.

2. Privacy

Any information you provide to YieldJump is subject to our Privacy Policy. By using the Services, you consent to the collection and use of your information for the purposes of managing your ownership stake and optimizing property performance. By submitting your contact information, you consent to receive communications regarding your inquiry, property performance reports, and portfolio opportunities.

3. Passwords & Security

You are responsible for safeguarding the credentials used to access the YieldJump Platform. YieldJump cannot and will not be liable for any loss or damage arising from your failure to maintain account security. You agree to notify us immediately of any unauthorized use of your account.

4. Mobile Application & Technology

In order to use the YieldJump mobile app, you must have a compatible mobile device. YieldJump does not warrant that the App will be compatible with all devices. The App is the primary tool for scheduling your stays, viewing rental income distributions, and accessing the "Portfolio Swap" features. By installing the App, you consent to automatic updates designed to improve property management and user experience.

5. Content & Exclusive Information

YieldJump does not verify the accuracy of all information provided by third parties on the Services. Reliance on such information is at your own risk.

  • Registrant Access: Registered users (“Registrants”) gain access to Exclusive Content, including detailed rental yield projections, operating expense data, and portfolio-wide availability.

  • Personal Use Only: All data obtained from the Exclusive Content is intended only for the Registrant’s personal, non-commercial use in evaluating a potential co-ownership stake. Registrants may not copy or redistribute this data.

6. YieldJump Rights & Intellectual Property

All rights, title, and interest in the Services, including the proprietary "Swap" algorithms and rental optimization tools, remain the exclusive property of YieldJump. You may not use the YieldJump name or trademarks without prior authorization.

7. Restrictions On Use

You may not: (i) tamper with non-public areas of the Platform; (ii) probe the vulnerability of our network; (iii) scrape the Services for real estate data without consent; or (iv) interfere with the access of any user or host, including the transmission of viruses or "spamming" the scheduling system.

8. The Portfolio Swap & Rental Program

  • Swap Program: Co-ownership in one YieldJump property may grant you the privilege to swap your stay-time with other properties in the YieldJump network. This is subject to the rules of the Swap Program and property availability.

  • Rental Opt-In: You acknowledge that the "Yield" component of YieldJump relies on professional management of the home as a short-term rental. Specific terms regarding the split of rental income and owner-use windows are governed by your LLC Operating Agreement.

9. Disclaimers & Limitations of Liability

The Services are Available “AS-IS”: Your access to the Services is at your own risk.

  • No Investment Guarantee: YieldJump disclaims all responsibility for the financial performance of any property. Real estate values and rental yields fluctuate based on market conditions.

  • Limitation of Liability: To the maximum extent permitted by law, the YieldJump Entities shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Services or your participation in a property LLC.

10. Ending These Terms

You may terminate this Agreement by deactivating your account and ceasing all use of the Services. YieldJump may suspend or terminate your access if we believe you have violated these Terms or if your actions create legal or financial risk for the co-ownership group.
